As per section 3 of Indian Partnership Act, 1932 the 'unrepealed provisions' of the Indian Contract
Act, 1872, shall continue to apply to firms. Such provisions of Indian Contract Act, 1872, however should not be inconsistent with the express provisions of Indian Partnership Act, 1932.
The use of ‘unrepealed provisions’
denotes the provisions which are not repealed by any amendment act of Indian
Contract Act, 1872
Thus all the provisions of Indian Contract Act, 1872 [as amended up to date], which are not inconsistent with the express provisions of Indian Partnership Act, 1932, shall apply to and in relation to the partnership firms.
To put it differently the provisions of Indian Contract Act, 1872 [as amended up to date] shall be applicable to the partnership firms, however any inconsistent express provision [to that of Indian Contract Act, 1872] of the Indian Partnership Act, 1932, shall have precedence over the provisions of Indian Contract Act, 1872 in relation to its applicability to the partnership firms.
