Duties of local authority to provide free and compulsory elementary education to every child



As per section 2 of Right of Children to Free and Compulsory Education Act, 2009, local authority means a Municipal Corporation or Municipal Council or Zila Parishad or Nagar Panchyat or Panchyat, by whatever name called. It includes such other authority or body having administrative control over the school or empowered or under any law for the being in force to function as a local authority in any city, town or village.

Right of Children to Free andCompulsory Education Act, 2009 cast duties upon every local authority to provide free and compulsory elementary education to every child and to:

(i) ensure availability of a neighborhood school as specified in section 6;

(ii) ensure that the child belonging to weaker section and the child belonging to disadvantaged group are not discriminated against and prevented from pursuing and completing elementary education on any grounds;

(iii) maintain records of children up to the age of fourteen years residing within its jurisdiction, in such manner as may be prescribed;

(iv) ensure and monitor admission, attendance and completion of elementary education by every child residing within its jurisdiction;

(v) provide infrastructure including school building, teaching staff and learning material;

(vi) provide special training facility specified in section 4;

(vii) ensure good quality elementary education conforming to the standards and norms specified in the Schedule;

(viii) ensure timely prescribing of curriculum and courses of study for elementary education;

(ix) provide training facility for teachers;

(x) ensure admission of children of migrant families;

(xi) monitor functioning of schools within its jurisdiction; and

(xii) decide the academic calendar.
